Guernsey is the name of an island located in the English Channel. Its territory is subject to the British Crown, but is not part of the United Kingdom of Great Britain. Guernsey belongs to the Channel Islands system and is also a member of the EU. The population of the island is about 65.5 thousand people. The area is only 63 sq. km, while the island is the second largest after Jersey. The official languages in Guernsey are English and French, but here you can hear completely different speech. After all, Guernsey is a famous international financial center. Investors from all over the world seek to invest their money in the companies of the island, as it has an impeccable European reputation and preferential taxation for foreign owners.

Advantages

As mentioned above, Guernsey is a reliable offshore. It is a politically and economically stable territory with a fairly developed financial sector. The proximity of European countries, as well as excellent transport links, distinguishes Guernsey from other jurisdictions.

Animal husbandry, tourism, and infrastructure are flourishing on the island. The offshore history of Guernsey began a very long time ago. The first offshore companies began to appear here in the 1960s of the last century. Currently, many subsidiaries belonging to world-famous companies are registered on the island. Their main areas of activity are:

  • Financial services;
  • banking sector;
  • legal activity;
  • administrative and accounting services.

Guernsey complies with EU free trade laws, but European taxation does not apply here. There is no currency control on the island. In addition to the British currency, the islanders use the Guernsey pound, which is related to the British pound in a ratio of 1:1.

Legislation

Registration of companies in Guernsey takes place on the basis of the Companies Act, adopted in Alderney in 1994. Foreign companies are registered on confidential terms. Public access is available only to information about the shareholders of the enterprise, the location of the office and the provision of annual reports. To maintain confidentiality, you can resort to the services of nominee directors and shareholders.

Judicial double taxation as a result of conflict of connecting factors which are commonly used by States to establish jurisdiction to tax the profits of multinational enterprises The main connecting factors which are commonly used by States to establish jurisdiction to tax the profits of multinational enterprises are “residence” and “source”, which are linked to concepts of “nationality” and “territoriality” used in public international law. Notions of residence and source are recognized by both OECD and UN and are reflected in their tax treaty models. Under residence approach, a state imposes its taxing rights of legal entity or individual based...

Nature and purposes of double taxation agreements and the issues of interpretation to which they may give rise Double Taxation Agreements (DTAs) are predominantly bilateral in nature. They are concluded on international level under international public law and thus on international level guarantee that they will become a part of domestic law of contracting states after their ratification. According to the...
